Our General Terms and Conditions

 

Legal basis

These travel conditions, which you accept with your booking, govern the contractual relationship between you as the traveler and us as the tour operator. The brands "Inselhüpfen" and "Islandhopping" are legally part of the tour operator Boat Bike Tours B.V., based in the Netherlands. The conditions apply to all bookings and are based on the EU Directive on Package Travel (EU) 2015/2302, which has been incorporated into Dutch civil law (Title 7a, Book 7). Please read the travel conditions carefully.

 

Registration

You can register in writing by mail, fax, Internet, or by email. If you register additional participants, your contract encompasses the contractual responsibilities for all the participants you registered.  By registering, you are offering us a binding travel contract. The contract is finalized through our confirmation.  Any additional arrangements or changes to the set contract must be made in writing.

 

Payment

A deposit in the amount of 20 % of the total trip price is due at the finalization of the contract.  With the deposit and the finalization of the contract, you will receive an insurance notice protecting you, as required by German law, from insolvency of the tour operator. The remainder of the payment is due sixty days before the start of the trip.  After booking you will receive an information booklet for the trip per email unless specifically requested by post; this is also a part of the travel contract and needs to be read carefully as it contains the most up-to-date information about the trip.

 

Services

The basis for the execution of the trip is the service description on our official websites (www.inselhuepfen.com and www.boatbiketours.de), which is also recorded and confirmed in the travel contract. We do not accept any liability for service descriptions communicated by our partner organizers.

 

Trip cancellation

If the minimum number of participants for guided tours is not met (minimum number of participants as stated in the travel description), we may (but are not obliged to) cancel the corresponding trip. In this case, we will make a decision on whether the trip will take place as soon as possible, but no later than 20 days before the start of the trip. If the minimum number of participants is not reached and we are forced to cancel a trip, all payments made will be fully refunded. No further claims will arise. In all cases where you are entitled to a refund of payments already made, we will carry out the refund immediately, but in any case within 14 days of the entitlement to a refund arising. In the event of danger, difficulty, or impairment of the trip due to force majeure, we as the tour operator also have the right to withdraw.

 

Changes by the tour operator


The tour operator may make minor changes to the contract as long as these do not impair the overall character of the trip. In such cases, we will inform you in a timely, clear, and understandable manner. Please note that minor changes cannot be rejected or used as a reason for a free cancellation. However, if a significant change becomes necessary before the start of the trip, we will inform you promptly and in an understandable manner. You will then have the choice to accept the changes or cancel the contract free of charge. If the change reduces the quality of the trip or lowers the cost, we will offer you an adjusted price calculation.

 

Cancellation and changes in reservations by customers

You can withdraw from the travel contract at any time before the start of the trip. In the event of a withdrawal, the date of receipt of the written cancellation notice is decisive. If you cancel, you are obligated to compensate the organizer for the damage incurred due to the cancellation. The damage amount is limited to the full travel price.

 

The cancellation fees depend on the timing of the cancellation and are set as follows:

 

  • Up to 84 days before the start of the trip: 20% of the travel price
  • From 84 to 42 days before the start of the trip: 30% of the travel price
  • From 42 to 28 days before the start of the trip: 60% of the travel price
  • From 28 to 1 day before the start of the trip: 90% of the travel price

 

In case of cancellation or no-show on the departure day, we will charge 100% of the invoice amount. If you miss the start of the trip or are prevented from continuing due to incomplete travel documents, this will be considered a withdrawal.

 

a) If two people have booked a double cabin together, and no replacement can be found to fill the space of the withdrawing candidate, we maintain the right to charge the remaining participant the corresponding accommodation surcharge, or if possible, to relocate them otherwise.

b) Changing to a new departure date is handled the same way as a cancellation.  For changing services in your reservation, we will charge 50 € changing fee for changes made 28 days or more before the beginning of the trip. This also includes changes of minor relevance like hotel stays, transfers, bike hire etc… Any later changes (if possible) will need to be handled as a cancellation and new registration. Cancellation and reservation change fees are due immediately.

c) In regard to the Covid Pandemic and in addition to our regular cancellation terms, a free cancellation or rebooking of your tour is possible 14 days prior if an official travel warning or quarantine measures at the time are unavoidable and prevent you from taking part on your planned Islandhopping trip.


Liability

We are liable, within the scope of due diligence expected of a conscientious businessman, for careful trip preparation, thorough selection and monitoring of service providers, the accuracy of service descriptions, and the proper provision of agreed travel services. If an essential part of the trip cannot be provided, the organizer will offer free, equivalent alternatives. If these alternatives are of lower quality, a price reduction will be offered. Our liability for damages that are not bodily harm is limited to three times the travel price, provided that the damage was not caused by us intentionally or through gross negligence. This also applies if we are solely responsible for the damage due to the fault of a service provider. The organizer's liability is excluded if the non-fulfillment of an obligation is due to your own actions, a consequence of unavoidable and extraordinary circumstances, or caused by a third party not engaged by the organizer to provide the travel services.

 

Panniers

To ensure the waterproofness of the provided saddlebags and provide good protection in the rain, the Ortlieb saddlebags must be properly sealed at the top. Although these bags are made of waterproof material, Boat Bike Tours B.V. categorically excludes any liability for personal items and devices carried, such as mobile phones and cameras.

 

Participation

A vacation that involves exercise and physical activity requires greater commitment than a conventional package tour. It is your duty to make certain that you are up to the physical challenges of such a trip.  The pre-condition for a bike-tour is that you are able to handle a bicycle in street traffic and on unpaved paths under any weather conditions.  If you rent a bike, it is your responsibility to check the condition of the bike, particularly the brakes.  You bear sole responsibility for adhering to all legal regulations at home and abroad, particularly regulations about travel documents and cross-border trade.  When traveling across the exterior borders of the EU, your luggage must remain unlocked, to facilitate passage through customs.  If your baggage is searched, you will be notified about it upon arrival at the destination.  If problems with the procurement of the services occur, you are required to help within the scope of legal regulations, in order to avoid potential damages or keep them at a minimum and report any complaints to us immediately.

 

Cancelation of the Travel Agreement by the Tour Operator

After an initial warning, Radurlaub ZeitReisen is entitled to cancel the travel agreement with immediate effect if a participant jeopardizes the wellbeing of other participants on the same tour.

 

Duty of Care

During the duration of the trip, you are liable for damages to or the loss of bicycles, e-bikes and equipment provided to you. With the bicycle insurance offered by us you can insure yourself against the aforementioned risks. This does not cover damages or losses caused by gross negligence or intent.

 

Warrantee

You can demand redress if the trip services are not rendered according to the contract. This can be solved by us providing compensation of equal or greater value.  In the case of disproportionate effort, corrective action can be denied.  For the period in which the services that have not been rendered according to contract, you can request a reduction in travel price after your return. The pre-condition for this is the immediate notification of our deficiencies or those of our tour guides, so that we have the opportunity to find a remedy.  Tour guides are not authorized to recognize claims.  Independent of a reduction in travel price, you can demand compensation due to non-compliance with the travel contract, unless we are not responsible for the defect.


Limitation of claim

Claims must be made in writing within one month of the contractual end of the trip.  The statute of limitation for claims based on the contract expires six months after the contractual end of the trip.  The statute of limitations for all claims of civil offence expires three years after the end of the trip.


Privacy of Personal Information

All personal information that you give us for the processing of the trip is protected against misuse under the General Data Protection Regulation.

 

Travel Protection

We urge you to consider effective travel cancellation cost insurance.  Before the trip, please also find out about your medical and accident insurance and about luggage insurance or travel liability insurance, if necessary.


Passport, Visa and Medical Regulations

It is your responsibility to inform yourself of, and to conform to, local and international rules and regulations, especially in regard to travel and import/export, whilst taking part on any of our tours. You are liable for any expenses and/or drawbacks which may arise as a result of your failure to do so. We do however try our very best to keep our clients up to date with the latest travel regulations.

 

Severability Clause

The nullification of individual clauses in the travel contract or the travel terms does not result in the nullification of the entire contract or the travel terms.


Place of Jurisdiction

The place of jurisdiction is the Netherlands.
